Livestream — Church-State Separation and the Supreme Court: Upcoming Cases

A discussion of the three cases is now pending decision before the Supreme Court whose outcomes will shape significantly the interpretation in law of the First Amendment’s Establishment and Free Exercise clauses. The cases (Catholic Charities, Mahmoud, and Oklahoma Statewide Charter School Board) deal with critical public policy issues ranging from criteria for determining the tax status of religious charities; the right of parents to be receive notice and opt-out options for classroom materials they deem inappropriate on religious grounds; and the establishment of state-funded religious charter schools.
David Leebron, distinguished legal scholar, dean of Columbia Law School, seventh president of Rice University (2004-2022), and current president and CEO of Texas 2036, will discuss with Baker Institute Director David Satterfield the evolution of Supreme Court thinking over the past 30 years on First Amendment Establishment and Free Exercise issues, and the implications for church-state separation and government entanglement with religion.
